The Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA) requires organizations with more than 20 employees to offer continuation of health insurance benefits upon a "qualifying event."
Qualifying Event and Period of Coverage
Terminating employee and/or enrolled dependents
Period of Coverage: Up to 30 months
An employee whose hours have been reduced to below eligibility level
Period of Coverage: Up to 30 months
Leave of absence without pay
Period of Coverage: Up to 30 months
Terminating employee and/or enrolled dependent who is determined by Social Security to be permanently disabled or who becomes permanently disabled within 60 days of the event
Period of Coverage: Up to 29 months
Enrolled dependent of deceased employee
Period of Coverage: Up to 36 months
Divorced/legally separated spouse and/or enrolled dependents
Period of Coverage: Up to 36 months
Enrolled dependent who no longer qualifies as a dependent
Period of Coverage: Up to 36 months
